Terms and Conditions

1 . Introduction

  • These Terms and Conditions (“Terms & Conditions”) govern participation in the Educating MIND-Y (trading name), also known as Educating MINDY (registered name), BETA Tester Programme (“The Programme”). By enrolling/signing-up, you agree to abide by these terms.

  • The Programme is limited to the first 30 participants (the terms “sign-up” and “enrolment” are used interchangeably) and will begin on 7th May 2025, with its duration depending on the release schedule of the workshops and the timing of enrolment.

  • Individuals who have paid to participate in The Programme (“Participants”) are expected to provide feedback, attend sessions, and comply with the requirements outlined below.

  • These Terms & Conditions do not negate the Terms of Service (https://www.educatingmindy.com/termsofservice/) or any other policy produced by Educating MIND-Y.

  • These Terms & Conditions do not negate the Privacy Policy (https://www.educatingmindy.com/privacypolicy/). Educating MIND-Y respects the privacy concerns of the users of its programme delivery website, of Podia Labs, Inc. (https://www.podia.com/terms) and the services provided by Educating MIND-Y. The Privacy Policy explains what information is gathered during a visit to the site and how such information may be used.

 

  1. Eligibility & Participation Requirements

To participate, participants must:

  • Read, understand, and accept Non-Disclosure Agreement (NDA) before accessing any programme materials, as acceptance is declared upon sign-up in the BETA Tester Programme.

  • Follow Educating MIND-Y on LinkedIn and engage with at least one post (like or comment).

  • Complete feedback for a minimum of 10 workshops two months from The

Programme start date, subject to availability of releases.

  • Submit a Feedback Video, outlining key takeaways.

  • Attend or watch back scheduled live feedback sessions as part of their contribution.

  • Failure to meet these requirements may result in disqualification from The Programme, revoking all access to the account, and loss of benefits.

  1. Programme Benefits

Each participant is assigned a role based on their engagement and level of access, outlined as follows.

  • Quality Champion (Standard Tier/All Participants)

    • Access to masterclasses on Conception, Framing & Organisation (15+ workshops).

    • Notifications of the latest releases.

    • Access to educational resources (7+ workbooks).

    • Permission to promote their voluntary role on social media.

    • OWicial certificate upon successful completion of The Programme.

  • Product Pioneer (Intermediate Tier)

Includes all benefits of the Quality Champion, plus:

  • Access to Product, Project & Change Management Programme (3 masterclasses).

  • Fortnightly Group Coaching sessions.

  • Opportunity to develop a personal portfolio.

  • Entry into Programme competitions (outlined in Clause 4.2).

  • Eligibility for future BETA Programmes.

  • Product Partner (Advanced Tier)

Includes all benefits of the Product Pioneer, plus:

  • Lifetime access to future BETA Programmes.

  • 1:1 Coaching sessions with industry professionals.

  • Collaboration opportunities to promote business via an Educating MIND-Y podcast.

  • Influence over product development and early access to concept previews before public release.

 

  1. Competitions & Rewards

  • Eligibility and Participation

    • Only participants in the Product Pioneer (Tier 2) and Product Partner (Tier 3) Programme tiers qualify for premium rewards.

    • Participants who enrol in the Programme are required to confirm their interested to enter into the competition for premium rewards upon sign-up. If a participant does not wish to enter the competition, they must notify Educating MIND-Y in writing via email (info@educatingmindy.com), stating their name, contact information, and that they do not wish to enter any competition.

  • Competitions

    • Enrolment Competition: Three (3) winners will receive three (3) additional coaching sessions.

    • Completion Reward (Premium Prize): Two (2) winners from the Product Pioneer and Product Partner tiers (who complete all feedback requirements and attend/watch live sessions) will receive a choice of one of the following premium rewards: o Nebulae Smart Watch (2024 Edition) o Amazon Echo Spot (2024 Edition)

                        o      Google Home Nest Hub (Gris Clair, 2024 Edition)

Note: These rewards will only be activated subject to a minimum of 30 total sign-ups.

  • Paid Entry & Disclosure Requirements

Participation in Programme competitions requires a paid entry as part of the Programme enrolment for premium rewards. By entering, participants acknowledge:

  • Competitions involve a payment to participate as outlined in their respective Programme tiers (Product Pioneer, Product Partner).

  • The method of selecting winners for the premium rewards will be selected through an automated, randomised process providing all Eligibility & Participation Requirements have been met.

A free alternative entry method (AMOE) is available for the secondary free reward (a coaching session):

  • Participants may enter without making a purchase by subscribing to email from the website or via the contact form (https://www.educatingmindy.com/bookacall/) or emailing info@educatingmindy.com by entering AMOE in the header, along with full name, contact details, and their personal barriers relating to The Programme subject.

  • Free entrants will receive a secondary reward: a free 1-hour coaching session (distinct from the premium rewards available to paid entrants).

  • Paid and free entrants will be treated equally in terms of their eligibility to win the secondary free reward, but paid entrants will have access to the premium prizes.

 

4.4 Randomised and Automated Selection Process

  • Winners of the premium rewards will be selected through an automated, randomised process, ensuring fairness and impartiality. All eligible entries will be included in the selection process.

  • The secondary free reward (coaching session) will be allocated randomly among all participants, regardless of whether they entered via paid enrolment or free entry (AMOE). However, premium prizes will be reserved for paid entrants in the appropriate tiers.

  • The selection process is final and cannot be appealed.

  • The automated system operates independently, without human intervention or bias, ensuring all participants have an equal chance based on the terms of the Programme.

  • A winner may choose to forfeit their reward and pass it on to the next eligible participant in the Programme, subject to Educating MIND-Y’s approval and compliance with the Programme’s terms by emailing us via info@educatingmindy.com

 

4.5 Entry Fees & Refund Policy

  • Entry Fees: Entry fees for participation in The Programme are required and generally non-refundable. However, participants may be entitled to a refund in accordance with applicable consumer protection laws, including but not limited to the Consumer Rights Act 2015 (UK), EU consumer protection regulations, and California consumer protection laws, if the service is not as described, not provided, or is defective in a material way.

  • Refund Conditions: If you feel that the service provided does not meet the expectations set out in The Programme description, or if you experience a technical failure or disruption that prevents you from participating as intended, you may be entitled to a partial or full refund in accordance with the relevant laws. Please respond within 30-days of sign-up, and email with the reasons you wish to withdraw via info@educatingmindy.com.

  • No Guarantee of Winning: While the payment of entry fees allows participation in the competition, it does not guarantee winning a prize.

 

  1. Disqualification & Termination

  • Participants may be disqualified if they:

    • Fail to meet the feedback and participation criteria outlined in Clause 2.

    • Breach the Non-Disclosure Agreement (NDA).

    • Engage in misuse of programme materials or attempt to distribute confidential content.

    • Exhibit inappropriate conduct, including harassment, discrimination, or disruptive behaviour within the community.
  • Educating MIND-Y reserves the right to terminate participation at any time if these conditions are not met and as stated in 2. Eligibility & Participation Requirements.

 

  1. Intellectual Property & Confidentiality

  • All materials, resources, and content provided within The Programme remain the intellectual property of Educating MIND-Y.

  • Participants must not share or distribute any Programme content without explicit written permission; however, they may reproduce the content for development of their personal portfolio as per The Programme’s intent.

  • Any feedback provided by participants may be used by Educating MIND-Y for programme improvements, marketing, or educational developments.

 

  1. Limitation of Liability

    • Nothing in these Terms & Conditions excludes or limits Educating MIND-Y’s liability for:
      • Death or personal injury caused by negligence;

      • Fraud or fraudulent misrepresentation;

      • Any other liability that cannot be excluded or limited by law in the UK, EU, or California.
  • Except as stated above, Educating MIND-Y’s total liability to you in connection with The Programme or any other matter arising from your participation will be limited to the amount you have paid for participation in The Programme (if any).

  • Educating MIND-Y is not responsible for technical failures, scheduling changes, or external factors ajecting participation, and does not guarantee that participation in The Programme will lead to any specific outcomes, including financial or professional gains.

 

  1. Governing Law & Amendments

  • These Terms & Conditions shall be governed in accordance with UK law and applicable consumer protection laws in the UK, EU, and California.

  • Educating MIND-Y reserves the right to modify or update these Terms & Conditions at any time. If a modification or update is made that materially ajects your rights or obligations, we will provide notice to participants at least 30 days before the changes take eject. You will have the option to withdraw from The Programme if you do not agree to the new Terms & Conditions. Withdrawal must be requested in writing within 30 days of receiving notice of the changes.

  • We will notify you of any material changes via email, and the updated Terms & Conditions will be available on our website. Please add info@educatingmindy.com to your safelist. If you continue to participate in The Programme after such modifications or updates, your continued participation will be deemed acceptance of the new Terms & Conditions.

 

   9.  Acceptance of Terms

  • By signing below, you acknowledge that you have read, understood, and agree to the Terms and Conditions outlined by Educating MIND-Y and the BETA Tester Programme. Your participation is subject to these terms, as well as the Privacy Policy and Terms of Service. By signing, you confirm your commitment to abide by them.
